U.S. law requires that all ISU employees be eligible to work in the United States. Employees of ISU are required to complete a Form I-9 in the Office of Human Resources or Student Employment Office on the first day of work. The employee must produce the required documentation at that time. Certain positions at ISU may be eligible for sponsorship of an H-1B petition. The position at issue must require a 4-year bachelor's degree and the employee (with a combination of education and experience) must clearly meet that qualification. In addition, the wage offered must meet the prevailing wage. Many positions are not eligible for H-1B sponsorship. ISU sponsors employees for Permanent Residency (or a "green card"), provided very specific requirements of the position, the search process, and long-term employment intentions are met. The permanent residency process does not usually begin until after an H-1B work visa has been successfully obtained. There are many facets to the permanent residency process, which can be both lengthy and costly. However, obtaining permanent residence allows individuals to work for any U.S. employer and to travel in and out of the U.S. without restriction. Dependents and spouses can also become permanent residents of the United States, which allows greater flexibility for family members. It is recommended that whenever a foreign national employee is
travelling outside of the United States, he or she should request a
letter from the Office of Human Resources confirming the employee's
continued employment at ISU. Employees are advised to visit the
Department of State webpage for the consulate requirements, as countries
differ in the documentation required. Please note that employees
are responsible for researching all travel issues, completing the
necessary forms, making consular appointments. ISU is not responsible for
ensuring that an individual is authorized to travel or will be able to re-enter the United States.
In some circumstances, including the period while an H-1B petition is pending, the employee should avoid travel outside of the United States, as the petition could be deemed by the U.S. government as abandoned. If international travel is required, please contact the Office of Human Resources.
